Part I — Warranty Disclosure

Forklift Select LLC ("Forklift Select") includes a complimentary Limited Powertrain Warranty with eligible equipment purchases. This warranty is provided and administered by JBI (the "Warranty Administrator"), a third-party warranty provider. Forklift Select is the reseller of this warranty product and does not underwrite, adjudicate, or assume any obligation under the warranty.

This disclosure is intended to help you understand what your warranty covers, what it does not cover, and what is expected of you as the Buyer. It is an overview of key concepts — the actual warranty document controls all coverage terms. Please review both this disclosure and the warranty terms below before completing your purchase.

1. Your Warranty Is a Limited Warranty

The warranty included with your purchase is limited protection against specifically covered failures. It is not a guarantee that the equipment will be free from defects, breakdowns, repairs, maintenance needs, or downtime, and it does not mean that every repair occurring during the warranty period is covered.

Coverage varies by equipment, age, condition, warranty program, and term. The specific written warranty accompanying your transaction establishes what is and is not covered.

2. Who Provides and Administers the Warranty

The warranty is provided and administered by JBI (the Warranty Administrator). The Warranty Administrator is solely responsible for making all coverage determinations, approving or denying claims, authorizing repairs, setting labor-rate and parts-cost parameters, and fulfilling warranty obligations.

Forklift Select includes this warranty as a complimentary purchase benefit at no additional cost to you. Forklift Select may help facilitate communication, collect documentation, or coordinate with the Warranty Administrator on your behalf, but this assistance is a courtesy. It does not make Forklift Select responsible for warranty coverage, claim outcomes, or any obligation under the warranty.

If a claim is denied or a dispute arises regarding coverage, the Buyer's recourse is with the Warranty Administrator, not Forklift Select.

3. Only the Written Warranty Controls

Statements such as "warranty included," "parts warranty," "powertrain warranty," or similar descriptions are summaries only. They do not expand the coverage stated in the applicable written warranty.

No salesperson, employee, broker, technician, or representative of Forklift Select has authority to modify or expand the warranty. Only the Warranty Administrator may authorize changes in writing.

Verbal statements do not modify the warranty.

4. What It Means for a Claim to Be Covered

A mechanical failure during the warranty period does not, by itself, mean it is covered. A claim is covered only when:

  1. the failed component is listed as covered in the written warranty;
  2. the failure occurred during the warranty term;
  3. the cause of failure is not excluded;
  4. all maintenance, operating, and claim requirements have been met; and
  5. the claim has been submitted, reviewed, and approved by JBI (the Warranty Administrator).

A covered component located near or connected to a non-covered component does not make the non-covered component eligible for coverage.

5. Items Not Expressly Covered Are Excluded

Unless specifically identified as covered, maintenance items, wear items, consumables, adjustments, and non-covered components are your responsibility. Depending on the warranty program, excluded items may include filters, fluids, coolant, seals, gaskets, hoses, fittings, radiators, and similar maintenance or wear-related components.

Diagnostic charges, service calls, technician travel, freight, transportation, towing, pickup and delivery, storage, shop supplies, environmental fees, taxes, expedited shipping, mobile service charges, equipment relocation costs, and other related expenses are not covered unless the Warranty Administrator approves them in writing.

6. Repairs Must Be Authorized Before Work Begins

No repair should be performed and no parts should be ordered until the warranty claim has been reviewed and written authorization has been provided by the Warranty Administrator.

To report a suspected warranty issue, contact: warranty@forkliftselect.com

You may be required to provide:

  • a written repair estimate;
  • technician diagnosis and findings;
  • photographs or video;
  • equipment serial number;
  • current hour-meter reading;
  • maintenance and service records;
  • parts and labor breakdown;
  • fault codes or diagnostic reports; and
  • any other information reasonably necessary to determine the cause and extent of the failure.

Repairs performed without required prior authorization may be denied, even where some portion of the repair might otherwise have qualified for coverage.

7. Maintenance Is Your Responsibility

Proper maintenance is a condition of warranty coverage.

You are responsible for performing all manufacturer-recommended inspections, maintenance, fluid changes, and routine service, and for documenting that work.

Failure to maintain the equipment properly, failure to provide maintenance records when requested, operation with insufficient fluids, continued operation while overheating or while warning indicators are present, or failure to address a known condition may result in denial of a claim.

8. Misuse, Overloading, and Improper Application Are Not Covered

Warranty coverage does not apply to failures caused or contributed to by abuse, misuse, neglect, overloading, improper attachments, unauthorized modifications, accidents, environmental conditions, or use outside the equipment's rated specifications. This includes, without limitation:

  • exceeding the forklift's rated capacity;
  • exceeding the rated load-center specification;
  • attempting to lift loads whose effective load center causes the forklift's actual capacity to be exceeded;
  • operating with improper or unapproved attachments;
  • impact or collision damage;
  • continued operation after overheating or another serious warning condition;
  • unauthorized modifications or repairs; and
  • severe-duty, high-impact, unusual, or specialized applications that were not disclosed when the equipment was selected.

The capacity shown on a forklift's data plate depends on configuration and load center. You are responsible for confirming that the equipment is appropriate for your actual loads, dimensions, attachments, operating environment, and application.

9. Stop the Machine If Something Is Wrong

If you experience overheating, coolant loss, low oil pressure, warning lights, abnormal gauge readings, unusual noises or vibrations, or any other condition suggesting a mechanical problem, stop operating the equipment immediately.

Damage caused by continued operation after a problem is known or reasonably apparent is not covered.

10. Failed Parts Must Be Retained

All failed or replaced parts must be kept until the Warranty Administrator has had an opportunity to inspect them. If parts are discarded before that inspection, the claim may be denied.

11. Downtime, Rental Equipment, and Consequential Expenses

Loss of use is not warranty coverage. Neither Forklift Select nor the Warranty Administrator is responsible for:

  • rental or replacement equipment;
  • lost production;
  • lost revenue or profits;
  • labor or employee downtime;
  • missed jobs or contracts;
  • storage costs;
  • business interruption;
  • expedited freight;
  • third-party penalties;
  • incidental expenses; or
  • indirect, special, incidental, or consequential damages arising from equipment downtime or failure.

The possibility that the Buyer may incur these expenses does not convert them into warranty-covered expenses.

12. The Warranty Does Not Provide a Right to a Refund or Replacement

A warranty claim does not entitle you to return the equipment, cancel the sale, receive a refund, or demand a replacement forklift. The sole remedy under the warranty is repair or replacement of covered components, subject to the warranty's terms and limitations.

All sales remain final except to the extent otherwise expressly agreed in writing or required by applicable law.

13. Used Equipment

Except for the express limited warranty provided with the sale, used equipment is sold as is, where is, and with all faults. Used equipment has experienced prior operation, and normal wear should be expected. The existence of a limited warranty does not convert used equipment into new equipment or guarantee every component of the machine.

14. Review Your Warranty Before Purchase

Warranty coverage may differ between machines and warranty programs. Your invoice, warranty certificate, warranty schedule, and warranty terms should be reviewed together before completing your purchase.

General advertising, website language, emails, photographs, sales discussions, or marketing descriptions do not expand or replace the written warranty.

Part II — Limited Powertrain Warranty

5 Years or 10,000 Hours — Whichever Occurs First

Warranty Provided and Administered by JBI

Included as a complimentary purchase benefit by Forklift Select LLC

1. Limited Warranty Overview

As a benefit of purchasing equipment from Forklift Select LLC ("Forklift Select"), Forklift Select includes, at no additional cost to the Buyer, a Limited Powertrain Warranty provided and administered by JBI ("Warranty Administrator").

Forklift Select is the reseller of this warranty product. Forklift Select does not underwrite, adjudicate, or assume any obligation under this warranty. All coverage determinations, claim approvals, inspections, and warranty obligations are the sole responsibility of JBI as the Warranty Administrator.

Forklift Select may assist in facilitating communication, collecting documentation, or coordinating with the Warranty Administrator on the Buyer's behalf. Such assistance is a courtesy and does not create any warranty obligation on the part of Forklift Select, constitute an admission that a failure is covered, or expand the terms of this warranty.

This warranty applies only to the original purchaser and only to the specific equipment identified in the applicable sales documents.

This warranty provides limited protection against catastrophic mechanical failure of certain major powertrain components due to defects in materials or workmanship.

This warranty is not an insurance policy, not a full machine warranty, and does not cover the forklift as a whole. It is not a guarantee that the equipment will be free from defects, breakdowns, repairs, maintenance needs, or downtime, and it does not mean that every repair occurring during the warranty period is covered.

2. Definitions

"Forklift Select" means Forklift Select LLC. Forklift Select is the reseller of this warranty product and has no obligation under this warranty beyond facilitating communication and documentation as a courtesy to the Buyer.

"Warranty Administrator" means JBI or such other third-party warranty provider as Forklift Select may designate from time to time. The Warranty Administrator is the provider of this warranty and is solely responsible for administering and adjudicating claims, approving repairs, conducting inspections, setting labor-rate and parts-cost parameters, and making all coverage determinations.

"Catastrophic Failure" means a sudden and complete mechanical breakdown of a covered component that prevents the equipment from operating or performing its intended function.

"Customer" or "Buyer" means the original purchaser of the equipment identified in this agreement.

"Reasonable and Customary Rate" means the prevailing reasonable and customary rate charged by qualified forklift or material-handling equipment repair facilities in the same or comparable geographic market where the equipment is located or the repair is performed.

3. Only the Written Warranty Controls

This written warranty establishes the duration of coverage, covered components, exclusions, monetary limits, labor coverage, claim requirements, and available remedies.

Statements such as "warranty included," "parts warranty," "parts and labor warranty," "powertrain warranty," or similar descriptions are summaries only and do not expand the coverage stated herein.

No salesperson, employee, broker, technician, service provider, or other representative of Forklift Select has authority to modify, enlarge, waive, or otherwise change this warranty. Only the Warranty Administrator may authorize changes, and any such change must be in writing.

Verbal statements do not modify this warranty.

4. Warranty Term

Coverage begins on the date the equipment is delivered to the Customer.

Coverage ends upon the earlier of:

  • Five (5) years from the delivery date
  • 10,000 operating hours recorded on the hour meter

If the hour meter is tampered with, disconnected, replaced, altered, or becomes unverifiable, this warranty is immediately void.

5. Covered Components (Powertrain Only)

Coverage is strictly limited to the following major powertrain assemblies.

Internal Combustion Forklifts

  • Engine block and internal lubricated components
  • Crankshaft
  • Pistons and piston rings
  • Connecting rods
  • Camshaft and timing gears
  • Cylinder head and valves
  • Transmission housing and internal gears
  • Torque converter
  • Drive axle assembly
  • Differential gears
  • Final drive components

Electric Forklifts

  • Drive motor
  • Drive motor controller
  • Reduction gearbox
  • Differential assembly
  • Final drive components

Coverage applies only to Catastrophic Failure of the listed components.

JBI (the Warranty Administrator) reserves the right to determine whether a failure qualifies as a covered powertrain failure.

6. New Equipment Coverage

This warranty may be offered in connection with new equipment where eligibility has been determined through review by Forklift Select and the Warranty Administrator, consistent with applicable original equipment manufacturer ("OEM") warranty programs and relationships.

Availability of this warranty for new equipment is not automatic and is subject to underwriting criteria established by the Warranty Administrator, the terms of the OEM warranty program, and any applicable agreements between Forklift Select, the Warranty Administrator, and the OEM.

Where a claim involves new equipment covered under both this warranty and an OEM warranty, the OEM warranty shall be pursued first. This warranty applies only to the extent the failure is not covered or resolved under the OEM warranty.

Where applicable, repairs on new equipment must be performed by OEM-authorized or Warranty Administrator-approved repair facilities, and replacement parts must meet OEM specifications.

Replacement parts for covered repairs on new equipment shall be new, OEM-equivalent, rebuilt, remanufactured, or reconditioned parts of equivalent quality.

7. Catastrophic Failure Requirement

Coverage applies only to Catastrophic Failure of a covered component as defined in Section 2.

The following conditions are not considered Catastrophic Failures and are not covered:

  • Gradual wear or deterioration
  • Loss of performance
  • Normal engine wear
  • Oil consumption within manufacturer tolerances
  • Reduced compression from normal operation
  • Minor scoring or internal wear
  • Noise or vibration complaints
  • Preventative repairs or performance restoration

8. Components Not Covered

Any component not specifically listed in Section 5 is excluded. Maintenance items, wear items, consumables, adjustments, and non-covered components are the Buyer's responsibility. An item is not covered merely because it is necessary to complete a repair involving another component.

A covered component located near, connected to, or affected by a non-covered component does not make the non-covered component a covered item. Damage resulting from the failure of an excluded or non-covered component is not covered unless resulting damage is expressly included by this warranty.

Excluded components include but are not limited to:

Hydraulic Systems

  • Hydraulic pumps
  • Control valves
  • Hydraulic cylinders
  • Hydraulic hoses and fittings
  • Mast lift or tilt components

Electrical Systems

  • Wiring harnesses
  • Sensors
  • Switches
  • Displays
  • Electronic modules not listed in Section 5

Wear Components

  • Brakes
  • Tires
  • Batteries
  • Filters
  • Fluids and lubricants
  • Belts
  • Hoses
  • Seals and gaskets

Structural Components

  • Mast
  • Forks
  • Carriage
  • Frame
  • Overhead guard

Cosmetic Conditions

  • Paint damage
  • Rust
  • Corrosion
  • Scratches or dents

9. Labor Coverage

Labor is covered only when the specific warranty purchased or provided expressly includes labor coverage.

Where labor is covered, reasonable labor costs associated with repair or replacement of covered components may be reimbursed, subject to the following:

  • Labor rates shall not exceed the Reasonable and Customary Rate as defined in Section 2.
  • Labor hours shall be based on manufacturer or industry standard book times where available, comparable repair history, qualified estimates, or other commercially reasonable information.
  • JBI (the Warranty Administrator) must approve labor hours and rates before work begins.
  • Repairs performed without prior written authorization may not be reimbursed.
  • Approval is required before incurring charges above the Warranty Administrator's approved limits.

10. Repair or Replacement Parts

If a claim is approved, the Warranty Administrator will, at its sole discretion, authorize repair of the defective component or replacement with parts of equivalent quality.

Used or Pre-Owned Equipment: Replacement parts for covered repairs on used or pre-owned equipment may include new, rebuilt, remanufactured, reconditioned, serviceable used, or equivalent-quality replacement parts, at the discretion of the Warranty Administrator.

New Equipment: Replacement parts for covered repairs on new equipment shall be new, OEM-equivalent, rebuilt, remanufactured, or reconditioned parts of equivalent quality.

The Warranty Administrator may source covered parts where doing so results in a more cost-effective or timely repair.

Replacement components do not extend the original warranty term.

11. Maintenance Requirements

Proper maintenance is a condition of warranty coverage. The Buyer is responsible for performing all manufacturer-recommended and industry-standard inspections, maintenance, lubrication, fluid changes, adjustments, charging procedures, and other routine service applicable to the equipment.

To remain eligible for coverage, the Customer must:

Follow Manufacturer Maintenance Schedule

Including but not limited to:

  • Oil changes
  • Filter replacement
  • Fluid service intervals

Use Manufacturer-Approved Fluids

All fluids, lubricants, and replacement parts must meet manufacturer specifications. Failures caused by improper fluids, contaminated fluids, or improper parts are not covered.

Maintain Documentation

Customers must retain:

  • Service logs
  • Maintenance records
  • Repair invoices

Failure to maintain the equipment properly, failure to provide requested maintenance records, operation with insufficient fluids or lubrication, continued operation while overheating or while warning indicators are present, or failure to address a known condition may result in denial of a claim where such conduct caused or contributed to the failure.

12. Fuel and Fluid Contamination Exclusion

Failures caused by fuel contamination, improper fuel quality, or contaminated lubricants are not covered. This includes but is not limited to:

  • Contaminated diesel fuel
  • Contaminated propane systems
  • Water contamination
  • Improper fuel mixtures
  • Use of non-approved lubricants

13. Deductible Per Claim

Each approved claim is subject to a $350 deductible per covered failure or occurrence.

The deductible will be the responsibility of the Customer and may be:

  • Paid directly to the repair facility, or
  • Deducted from reimbursement issued by JBI.

Where multiple covered components fail from the same documented root cause, the failures will be treated as one claim event subject to a single deductible.

Separate or unrelated failures are subject to separate deductibles, even if discovered or reported during the same service visit.

14. Claim Procedure

The occurrence of a mechanical failure during the warranty period does not, by itself, establish warranty coverage. A claim is covered only when all of the following conditions are met:

  1. The failed component is covered by this warranty;
  2. The failure occurred during the applicable warranty term;
  3. The cause of failure is not excluded;
  4. All maintenance, operating, and claim requirements have been satisfied; and
  5. The claim has been submitted, reviewed, and approved by the Warranty Administrator.

To initiate a warranty claim, the Customer must:

Step 1: Notify Forklift Select or JBI immediately upon discovering the issue by contacting warranty@forkliftselect.com.

Step 2: Provide the following information:

  • Equipment serial number
  • Current hour-meter reading
  • Description of failure
  • Written repair estimate
  • Technician diagnosis and findings
  • Parts and labor breakdown
  • Fault codes or diagnostic reports
  • Maintenance and service records
  • Photos or video if requested
  • Any other information reasonably necessary to determine the cause and extent of the failure

Step 3: Obtain a diagnostic report from a qualified technician.

Step 4: JBI (the Warranty Administrator) must approve repairs before work begins.

Submitting an estimate or claim does not constitute approval. A salesperson's awareness of a problem, a conversation with a technician, or submission of an invoice does not constitute warranty authorization.

Failure to obtain authorization may result in claim denial.

15. Unauthorized Repairs

The Buyer may not authorize repairs, replace components, disassemble equipment, or incur expenses and then assume that JBI or Forklift Select will reimburse those costs.

Repairs performed without required prior authorization may be denied, even where some portion of the repair might otherwise have qualified for coverage.

The Warranty Administrator must be given a reasonable opportunity to investigate the reported condition, obtain diagnostic information, determine coverage, source covered parts where applicable, and approve the appropriate repair procedure.

16. Diagnostic Teardown

The Warranty Administrator may require component disassembly or inspection to determine failure cause.

Additional inspection or diagnosis may be required before a coverage decision can be made.

If the failure is determined not to be warrantable, the Customer is responsible for diagnostic and teardown costs.

17. Inspection Rights

JBI (the Warranty Administrator) reserves the right to inspect the equipment before authorizing major repairs.

JBI may require a second opinion or independent inspection when reasonably necessary to verify the cause of failure, confirm the extent of damage, or evaluate the proposed repair.

The Customer shall make the equipment reasonably available for inspection at a mutually agreeable time and location.

18. Failed Parts Retention

All failed or replaced parts must be retained by the Customer or the repair facility until JBI (the Warranty Administrator) has had a reasonable opportunity to inspect them.

If failed parts are discarded, disposed of, or otherwise made unavailable before JBI has completed its review, JBI may deny the claim in whole or in part.

JBI will communicate any parts-retention or return requirements at the time a claim is initiated or approved.

19. Repair Facility

The Customer may use a qualified repair facility, provided the repair is performed within the labor hours and rates approved by JBI (the Warranty Administrator).

JBI reserves the right to require or designate a particular repair facility when reasonably necessary, including but not limited to situations involving:

  • Specialized or complex repairs
  • Second-opinion or diagnostic concerns
  • Quality concerns with a proposed facility
  • Situations where the Customer's chosen facility will not perform the repair within approved cost parameters

20. Continued Operation After Failure

The Customer must immediately cease operating the equipment upon discovering or suspecting any of the following conditions:

  • Overheating
  • Coolant loss
  • Low oil pressure
  • Warning lights or indicators
  • Abnormal gauge readings
  • Unusual noises, vibrations, or smoke
  • Any other condition suggesting a significant mechanical problem

Damage caused or worsened by continued operation after the Customer knew or reasonably should have known that a significant mechanical problem existed is not covered.

The Customer is responsible for taking reasonable steps to prevent further damage after discovering a problem.

21. Separate Failures

Approval of one warranty claim does not automatically establish that a subsequent failure is related to a previously approved claim or that any subsequent failure is covered.

Each claim shall be evaluated independently on its own merits, including cause of failure, maintenance history, and compliance with warranty requirements, unless there is documentation demonstrating that the failures share a common root cause.

22. Warranty Remedy

Where a valid covered claim exists, the sole remedy under this warranty is repair or replacement of the covered component by JBI (the Warranty Administrator), subject to the terms and limitations stated herein.

This warranty does not provide the right to:

  • Return the machine
  • Cancel the sale
  • Receive a refund
  • Demand a replacement forklift
  • Require Forklift Select to repurchase or exchange the equipment

All sales remain final except to the extent otherwise expressly agreed in writing or required by applicable law.

23. Operating Condition Exclusions

This warranty does not cover failures or damage caused or contributed to by:

  • Abuse or misuse
  • Neglect
  • Overloading beyond rated capacity
  • Exceeding the rated load-center specification
  • Operating with improper or unapproved attachments
  • Accidents or collisions
  • Impact or collision damage
  • Fire, flood, or natural disasters
  • Environmental conditions
  • Improper transportation
  • Unauthorized modifications or repairs
  • Use of non-approved parts
  • Continued operation after overheating or another serious warning condition
  • Use outside the equipment's rated specifications or intended application

The capacity shown on a forklift's data plate is dependent upon configuration and load center. The Buyer is responsible for confirming that the equipment purchased is appropriate for the actual loads, dimensions, load centers, attachments, operating environment, and application in which it will be used.

Unless expressly warranted in a separate writing signed by Forklift Select, Forklift Select does not guarantee that equipment is suitable for a particular application based upon incomplete or inaccurate information supplied by the Buyer.

24. Severe Duty or Rental Use

Equipment used for rental fleets, high-impact environments, severe-duty applications, or specialized applications not disclosed at the time of sale may be excluded from coverage.

25. Additional Expense Exclusions

The following expenses are not covered unless the Warranty Administrator expressly approves them in writing:

  • Towing
  • Transportation
  • Storage
  • Expedited freight
  • Mobile service charges
  • Diagnostic travel
  • Equipment relocation costs
  • Service call charges
  • Technician travel
  • Pickup and delivery
  • Shop supplies
  • Environmental fees
  • Taxes
  • Any other expense not expressly covered by this warranty

26. Limitation of Liability

Neither Forklift Select nor the Warranty Administrator shall be responsible for:

  • Equipment downtime
  • Loss of productivity
  • Rental or replacement equipment
  • Lost revenue or profits
  • Labor or employee downtime
  • Missed jobs or contracts
  • Business interruption
  • Third-party penalties
  • Freight charges unless pre-approved
  • Incidental expenses
  • Indirect, special, incidental, or consequential damages arising from equipment downtime or failure

Loss of use is not warranty coverage. The possibility that the Buyer may incur these expenses does not convert them into warranty-covered expenses.

27. Maximum Warranty Liability

The maximum liability under this warranty is subject to the following limits:

  • Per-Claim Maximum: The maximum payout for any single covered claim shall not exceed twenty percent (20%) of the original equipment purchase price.
  • Lifetime Maximum: The maximum cumulative liability over the life of this warranty shall not exceed fifty percent (50%) of the original equipment purchase price.
  • Fair Market Value Cap: In no event shall the amount paid on any claim exceed the fair market value of the equipment immediately prior to the failure giving rise to the claim.
  • Certificate Maximum: Where a maximum benefit is listed on the warranty certificate, the lower of that amount and the limits stated above shall apply.

Once the applicable lifetime maximum has been reached, all warranty obligations shall be considered fulfilled.

28. Non-Transferability

This warranty applies only to the original purchaser and cannot be transferred if the equipment is sold or transferred.

29. Warranty Administration

This warranty is provided, administered, serviced, and adjudicated by JBI (the "Warranty Administrator"). JBI is the sole party responsible for coverage determinations, claim approvals, inspections, repair authorizations, and all warranty obligations under this agreement.

Forklift Select is the reseller of this warranty product and includes it as a complimentary benefit with the purchase of eligible equipment. Forklift Select does not underwrite, adjudicate, or assume any warranty obligation. Any assistance provided by Forklift Select in connection with a claim is a courtesy and does not create any liability, warranty obligation, or admission of coverage on the part of Forklift Select.

Any goodwill assistance provided by Forklift Select in one instance does not modify this warranty or create an obligation to provide similar assistance in the future.

30. Claim Investigation

JBI or Forklift Select may inspect equipment, obtain estimates, communicate with technicians, provide parts, participate in repair costs, or otherwise attempt to help resolve a Customer concern.

Such activity does not constitute an admission that the condition existed at the time of sale, that Forklift Select or JBI caused the condition, that the condition is covered, or that either party has any legal obligation beyond this written warranty.

31. Used Equipment

Except for the specific express limited warranty identified in the sales documents, used equipment is sold as is, where is, and with all faults.

Used equipment has experienced prior operation and normal wear should be expected. The existence of an express limited warranty does not convert used equipment into new equipment or create a guarantee concerning every component of the machine.

Except for the express limited warranty specifically provided in writing, Forklift Select disclaims all other warranties to the maximum extent permitted by law, including any implied warranty of merchantability and any implied warranty of fitness for a particular purpose. There are no warranties that extend beyond the express written warranty provided with the sale.

32. Warranty Documents Control

The Buyer acknowledges that warranty coverage may differ between machines and warranty programs. The Buyer's invoice, warranty certificate, warranty schedule, and any applicable warranty terms should be reviewed together.

Where the specific warranty schedule expressly provides coverage that differs from a general provision in this document, the specific written warranty provision governing that coverage controls.

General advertising, website language, emails, photographs, sales discussions, or marketing descriptions do not expand or replace the specific written warranty provided with the equipment.

33. Governing Law

This agreement shall be governed by the laws of the State of Colorado.

Any disputes shall be resolved in Denver County, Colorado.

34. Entire Agreement

This document represents the entire warranty agreement and supersedes all prior representations or agreements.

35. Acceptance

By accepting delivery of the equipment, the Customer acknowledges and agrees to the terms of this Limited Powertrain Warranty. Payment of the invoice for the equipment after receipt of this warranty and the accompanying Warranty Disclosure constitutes acceptance of all terms herein, with the same force and effect as a signed writing.

Customer Acknowledgment

This disclosure and acknowledgment forms part of the invoicing process. Payment of the invoice for the forklift constitutes the buyer's acknowledgment of, and agreement to, this disclosure in full. By submitting payment after receiving this disclosure, the buyer acknowledges and agrees that:

  • I understand that the warranty provided with my equipment is a complimentary limited warranty included as a purchase benefit by Forklift Select, and that it is provided and administered by a third-party Warranty Administrator (JBI). Forklift Select does not underwrite or assume any obligation under the warranty.
  • I understand that the warranty is a limited warranty and is not a guarantee against all mechanical failures or repair expenses.
  • I understand that only components and expenses expressly covered by the applicable written warranty are eligible for coverage.
  • I understand that warranty approval must be obtained from the Warranty Administrator before repairs are performed or expenses are incurred.
  • I understand that rental equipment, downtime, lost revenue, lost production, and incidental or consequential expenses are not covered unless expressly agreed otherwise in writing.
  • I understand that misuse, overloading, improper load-center calculations, insufficient maintenance, unauthorized modifications, improper application, and continued operation after a known problem may result in denial of warranty coverage.
  • I understand that a warranty claim does not automatically entitle me to return the equipment, receive a refund, or receive replacement equipment.
  • I understand that all failed parts must be retained for inspection by the Warranty Administrator and that disposal of parts before inspection may result in claim denial.
  • I understand that if a claim is denied or a coverage dispute arises, my recourse is with the Warranty Administrator, not Forklift Select.
  • I acknowledge that I have received, reviewed, and had an opportunity to ask questions regarding the warranty applicable to this purchase before completing the transaction.

No signature is required. Payment of the forklift invoice constitutes the buyer's acceptance of, and agreement to, this Warranty Disclosure & Customer Acknowledgment in full, with the same force and effect as a signed writing.
